Terms of Service

These Terms of Service ("Terms") govern your use of the Natural Thrive Keto mobile application (the "app", "Service"), operated by Natural Thrive ("we", "us", "our"). By downloading, installing, or using the app, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the app.

1. Acceptance

You accept these Terms by tapping "I understand and agree" on first launch, by continuing to use the app, or by maintaining a subscription. If you are using the app on behalf of an organization, you represent that you have the authority to accept these Terms for that organization.

If at any time you do not agree to these Terms, your remedy is to uninstall the app.

2. Eligibility

You must be 18 years or older to use this app. The app, the keto diet, fasting protocols, and supplements covered are designed for adult use only. Do not use the app if you are under 18.

You must not be barred from using the app under the laws of any jurisdiction that applies to you. If you are using the app from outside the United States, you are responsible for ensuring your use is lawful in your jurisdiction.

3. License to use the app

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the app on a device you own or control, solely for your personal, non-commercial purposes, and subject to these Terms.

You may not:

• Copy, modify, distribute, sell, rent, lease, or sublicense the app
• Reverse engineer, decompile, or disassemble the app, except where such restrictions are prohibited by law
• Use the app to build a competing product or service
• Use the app in any way that violates applicable law
• Use automated tools, scrapers, or bots to interact with the app
• Attempt to bypass subscription gates, trial limits, paywalls, or other access controls
• Use the app to harass, harm, deceive, or impersonate anyone

We may suspend or terminate your access to the app if you violate these restrictions.

4. Your account and data

The app does not currently use a server-side account system. Your profile, meal logs, supplement stack, biomarker readings, and other data are stored on your device. You are responsible for backing up or exporting any data you want to keep before uninstalling the app or changing devices.

When you use the AI features (photo meal scanning, ketone strip scanning, voice meal logging) or the barcode scanner, content is sent to third-party providers for processing. The handling of that content by those providers is governed by their privacy policies. See the Privacy Policy for the full list.

You own the health data you enter into the app. We do not claim ownership of your data.

You are responsible for the accuracy of the data you enter. Logging incorrect macros, ketone readings, or other information will affect the app's calculations, nudges, and milestones. The app cannot detect or correct user-entered errors.

5. Subscriptions, trials, and payments

The app offers a free tier and a premium subscription tier. The premium tier unlocks features described on the in-app paywall.

Free trial. New users receive a free trial of premium features. The trial duration and any usage caps (such as a maximum number of AI scans) are described on the in-app paywall at the start of the trial. The trial ends automatically when the duration or usage cap is reached; no payment is taken if you do not subscribe.

Subscription billing. Premium subscriptions are billed monthly or annually, at the price shown in the app at the time of purchase. Billing is processed by Apple App Store, Google Play, or another platform-specific payment processor — never by us directly. We never see your credit card or payment details.

Renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can cancel anytime from your App Store or Play Store subscription settings — not from within the app.

Refunds. Refunds are handled by Apple, Google, or the platform that processed your payment, according to their refund policies. We do not issue refunds directly. Contact the platform's support for refund requests.

Price changes. We may change subscription prices in the future. We will notify you of any price change at least 30 days before it takes effect for your subscription. If you do not agree, you can cancel before the change takes effect.

6. AI-generated content and accuracy

The app uses third-party AI models to identify foods, parse spoken descriptions, and read ketone strip images. AI output is not always accurate. The app shows you what the AI returned so that you can review and correct it before logging. You are responsible for reviewing AI output for accuracy.

We are not liable for incorrect macros, ketone readings, or other data resulting from AI errors. Always verify what you log.

7. Health and medical disclaimer

The app is an educational and self-tracking tool. It is not medical advice and not a substitute for professional healthcare. Full health and medical terms are in the Disclaimer, which is incorporated into these Terms by reference.

• The app does not diagnose, treat, cure, or prevent any disease
• Consult your doctor before starting any keto, fasting, or supplement protocol
• Do not use the app if you have certain conditions (diabetes, kidney/heart/liver disease, eating disorders, pregnancy, etc.) without medical supervision
• Supplements are not evaluated by the FDA — read every label
• Individual results vary; nothing is guaranteed

By using the app, you accept that you are doing so at your own risk and are responsible for your own health decisions.

8. Intellectual property

The app, including its design, code, branding, name ("Natural Thrive Keto"), logos, content, and underlying technology, is owned by Natural Thrive and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of any of that to you.

You retain ownership of the data you enter into the app and any content you create using its sharing features.

When you use the Share My Win or similar sharing feature, you grant us a non-exclusive, royalty-free license to render your tracked data into the shared image format. We do not store or use the shared image outside of generating it for you.

9. Third-party services

The app integrates with third-party services as described in the Privacy Policy. Your use of those services through the app is also subject to the third party's own terms and policies. We are not responsible for the practices or content of third-party services.

10. Disclaimer of warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, and uninterrupted availability.

We do not warrant that:

• The app will be error-free, secure, or available at any particular time
• The app's calculations, AI output, or insights will be accurate
• The app will produce any specific health, fitness, or weight outcome
• Defects in the app will be corrected on any specific timeline

11. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, use, goodwill, or other intangible losses — arising from your use of or inability to use the app
• We are not liable for any health, medical, or physical consequences arising from your use of the app, your reliance on its data, or your following of any diet, fasting, or supplement protocol it tracks
• Our total cumulative liability to you for any claim arising from or relating to the app is limited to the greater of (a) the amount you paid us for the app in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100)

Some jurisdictions do not allow certain warranty disclaimers or liability limitations. In those jurisdictions, our liability is limited to the smallest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Natural Thrive and its affiliates, contributors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the app
• Your violation of these Terms
• Your violation of any third-party rights, including health, privacy, or intellectual property rights
• Any content or data you submit or generate through the app

13. Termination

We may suspend or terminate your access to the app at any time, with or without cause, with or without notice. Reasons may include but are not limited to violations of these Terms, abuse of AI features, fraudulent payment activity, or legal compliance.

You may terminate your use at any time by uninstalling the app and canceling any active subscription through the App Store or Play Store.

Upon termination, the license granted in Section 3 ends. Provisions of these Terms that by their nature should survive termination (including disclaimers, liability limitations, indemnification, and dispute resolution) will continue to apply.

14. Changes to these Terms

We may update these Terms as the app evolves or as the law changes. When we make material changes, we will update the "Last updated" date at the top and may surface a notice within the app at next launch. Continued use of the app after changes take effect means you accept the updated Terms.

If you do not agree to changes, your remedy is to stop using the app.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict of law principles. Any dispute arising from or related to these Terms or the app shall be brought exclusively in the state or federal courts located in Fort Mill, South Carolina and you consent to the jurisdiction of those courts.

If informal resolution is unsuccessful, you and we agree to resolve disputes through binding individual arbitration where permitted by law, rather than class actions or court trials. This clause does not apply to disputes that cannot be arbitrated under applicable law.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. The unenforceable provision will be modified to the minimum extent needed to make it enforceable, or removed if no such modification is possible.

17. Entire agreement

These Terms, together with the Disclaimer and Privacy Policy, constitute the entire agreement between you and us regarding your use of the app. They supersede any prior agreements.
